The Supreme Court ruled sharply against stand-up comedian Samay Raina on Monday, August 25, for making fun of people with disabilities in his show India’s Got Latent, highlighting the need for comedians and influencers to be sensitive. Raina and four other people, Balraj Paramjeet Singh Ghai, Nishant Jagdsish Tanwar, Vipul Goyal, and Sonali Thakkar, also known as Sonali Aditya Desai, were ordered by the top court bench to provide a sincere apology on their YouTube channels and podcasts in addition to in court.

“Be careful when you make fun of others,” the Court remarked, warning that today’s ridicule of the disabled could tomorrow extend to women, children or senior citizens.
Guidelines for content on OTT to come soon?
Although Raina and four other comics were the sole subjects of Monday’s hearing, the top court’s findings were generally seen as a warning to all of the nation’s stand-up comedians and internet influencers.

The Supreme Court also noted that social media influencers who profit from their platforms are not permitted to claim the right to free expression. The SC emphasised that such monetised content entails obligations and limitations since it is commercial speech rather than free speech.

The Supreme Court also pushed the Centre to introduce broad-based standards to govern “vulgar and crass” content on social media and OTT platforms, sending a powerful message to the entertainment and influencer community.
It said that these rules must be formulated with the assistance of domain specialists and adhere to constitutional precepts.
“We have to decide where freedom of expression ends and where duties and reasonable restrictions begin. We need to balance,” the bench observed, signalling the urgent need for a regulatory framework.
In his show, Raina allegedly made offensive comments about a baby with spinal muscular atrophy (SMA) and individuals with visual impairments.
